This information is important where a Local Authority becomes involved in welfare issues relating to a child. This is usually because they are worried about physical or sexual child abuse or because there are concerns over neglect. It is a very difficult area of law because there are important Human Rights involved.
If you are the victim of abuse within a relationship then not only can the criminal justice system offer you protection, the civil courts can too. There are two different court orders which can be made to protect you from further violence or abuse. Unlike the criminal system they are not designed to punish the Perpetrator for previous incidents of abuse but to protect you from abuse or violence in the future.
This information relates to disputes about children that involve parents and/or other family members but not a public authority. Before applying to the Court for an order concerning a child, you will nearly always have to attend a Family Mediation Information and Assessment Meeting (MIAMS). This is to see if the dispute can be resolved without going through the court process.
You need to show that you have been married for over a year and that the relationship has broken down irretrievably. The other party has committed adultery and you find it intolerable to live with them. You cannot rely on adultery for the divorce if you carry on living with the other party for more than 6 months after finding out about it.
