At GLC we are specialists in advising about the steps grandparents need to take to try and resolve certain difficult issues. These can include contact with Grandchildren, taking on children when a parent cannot look after a child, and Grandparents being involved in care proceedings involving a grandchild.
The family court recognises the importance and benefits of a child having a relationship with a grandparent. Therefore, if you do not see your grandchild, you can take steps to resolve this and we would suggest you call us in the first instance and we can explain your options and the different levels of service that we can offer you.
If the Local Authority wish to remove a child from their parents without their consent, they must issue Care Proceedings and obtain a Care Order for the child. Grandparents and Grandparents childcare is not automatically considered. The Mother of the child is automatically involved and any person including the Father who has Parental Responsibilityfor the Child is also automatically involved.
Unfortunately, whether a Care Order, Special Guardinship Order (SGO) or Child Arrangement Order, a lack of support from the Local Authority can sometimes cause a breakdown in a kinship care placement. Often, the most common reason for placement breakdown is a lack of support. Kinship carers are often caring for very damaged or disabled children who require a high level of support from their Local Authority.
As a Grandparent with full time care of your grandchild you might need to consider Special Guardianship. Special Guardianship is where you take on the responsibility of caring for your grandchild until they are 18 years of age. It gives you Parental Responsibility (PR) for your grandchild over and above that of the parents.
