UK nationals buying a property in France, perhaps for the first time, are going to be faced with a variety of matters with which they are going to be unfamiliar. Buying a property in France, selling a property in France or inheriting or bequeathing a property in France can be a minefield without specialist advice from Anglo French lawyers able to give you the correct and relevant legal advice on French law.
The first contract which the buyer is asked to sign, very often in the Estate Agents office, is more often than not drawn up by the estate agents who have no legal qualifications. Because the estate agent's priority is to get a first contract signed by the buyers, there is a natural tendency for the Estate Agents to gloss over any problem areas there might be with regard to the property.
People buying a property in France do not generally have their own lawyer acting for the on the purchase. This comes as a big surprise to UK nationals who are used to having their own lawyer acting for them when buying a property in the UK.
You need to be aware that the French Notaire (who is a French Government appointee) generally acts for both parties on the purchase of a property and in those circumstances does not technically actually act for or owe any duty towards either of the parties.The Notaire does not fulfil the same role as a Solicitor does in England.

How you purchase the property can make a great difference as far as your ability to pass the property on to those to whom you able to pass it following the death of one of the owners and the amount of French inheritance tax which will be payable in that event. This arises from the French legal rules which require an owner to pass a specified proportion of the property he or she owns in France to their own biological children.

David Barney represented a buyer trying to buy our house in France. He was rude, unprofessional and threatened actions such as our buyer withdrawing if we dont have a clause to say our house would be rewired. 8 months into the house sale - he had failed to tell his client to pay a deposit - and his client never came up with the funds to buy the house. This left us thousands of pounds down after rewiring our house and being forced out of our property to meet the requested completion date. 7 weeks after the initial completion date, we were told by Mr Barney that the bank had stolen the clients money

PLEASE DO NOT USE THIS SOLICITOR!!!! He acted for our purchaser- failed to ensure his client paid a deposit which breached the contract and yet still continued to ensure us his client would pay funds - accept his client never got the funds together for the house either!!! We moved our family out of our home in good faith. It has cost us an absolute fortune. He is extremely rude and offers no apologies for how unprofessional he is!
