Welcome to Fenton Family Law, experienced family legal services based in Wincanton, Somerset. If you need legal advice about family issues it probably means you have things happening in your life at the moment that are difficult. I have practiced family law in Somerset for thirty years and trained as a specialist collaborative lawyer.

This experience has convinced me that the best way to resolve family disputes and issues is by discussion, collaboration and agreement. Where appropriate, I recommend this as a means of dealing with family problems, avoiding lengthy and expensive disputes in court which often result in less than ideal solutions for either party.

I qualified as a solicitor in 1978, having trained in Bristol and London, and have specialised in Family Law for the past fifteen years. In 2007, I trained as a Resolution certified collaborator, because I believe that non-confrontational solutions are preferable to court-imposed orders. This led to the founding of Fenton Family Law in 2012, in Wincanton, Somerset.
As their name implies, separation agreements are entered into after a relationship has broken down, and the parties go their separate ways. It is important that any separation agreement deals with all the relevant issues, financial and otherwise, which need sorting out at the time of the relationship breakdown.
Financial Issues are often the most significant and worrying issues following a relationship breakdown. The future may look uncertain, and it is quite normal and usual for parties to be concerned as to how their finances will be considered as part of the breakdown process. Housing is often the first worry on people's minds, particularly if there are dependent children.
In recent years the law has taken a very different view to parties entering into financial agreements before marriage. Not so long ago these prenuptial agreements would have simply been ignored by judges if the matter went to court.

Things have moved on, and although there are still some technical issues relating to the enforcement of pre-nups, the courts will generally uphold them provided the parties have been properly advised both legally and financially, and they have made full and frank disclosure of their finances to the other.
It is very important that you have as much information as possible about the potential legal costs of proceeding with any legal action. I have a professional duty to give you my best estimate of the likely costs, and if this changes, to keep you informed. I will normally send you a bill when the cost of work done is more than 100.
