Collaborative divorce is a legal process enabling couples who have decided to separate, or end their marriage, to work with their collaborative professionals including collaboratively trained lawyers, family consultants and financial professionals in order to avoid the uncertain outcome of court and to achieve a settlement that best meets the specific needs of both parties and their children without the underlying threat and cost of litigation.
A round table meeting consists of the lawyers and their clients and may also include a family consultant and financial adviser, all gathering round a table. The round table process is used to facilitate better communications and discussions of ideas and views. A successful round table divorce will keep the process out of court but does not bar clients going to court with their respective lawyers.
Mediation is an interactive process where impartial professionals such as mediators and family consultants join together to help the parties in resolving conflict through the use of specialised communication and negotiation techniques. Mediation focuses primarily on the needs, rights, and interests of the parties.
As the neutral family consultant I am able to meet with either or both clients out of meetings, providing both parties give their consent. These meetings are for each person to discuss their own personal situation and they will have my help to develop coping mechanisms and explore their own feelings and viewpoints.
