Asbestos is a hidden killer that can cause four serious diseases (described below). These diseases will not affect you immediately; they often take a long time to develop, but once diagnosed, it is often too late to do anything. There is a need for you to protect yourself now. Mesothelioma - a cancer which affects the lining of the lungs (pleura) and the lining surrounding the lower digestive tract (peritoneum).
In practice the changes are fairly limited. They mean that some types of non-licensed work with asbestos now have additional requirements, i.e. notification of work, medical surveillance and record keeping. All other requirements remain unchanged. If existing asbestos containing materials are in good condition and are not likely to be damaged, they may be left in place; their condition monitored and managed to ensure they are not disturbed.
If you are responsible for managing the maintenance and repair of a building, you must manage any asbestos in it. As well as protecting people from exposure to asbestos fibres, you have a legal duty to manage asbestos (under regulation 4 of the Control of Asbestos 2012). If you are unsure whether you are a duty holder seek professional advice.
The use of all asbestos containing materials was not banned until 1999. This means any building built or refurbished before the year 2000 could contain asbestos. Any worker liable to disturb asbestos while performing their normal everyday work is required to be trained.
Every employer must ensure that adequate information, instruction and training are given to those employees who are liable to be exposed to asbestos during the course of their work. All workers who are liable to disturb asbestos during their normal work should be trained so that they can recognise asbestos containing materials and know what to do if they come across them.
