If you have been able to reach an agreement between yourselves then we can help you at the beginning or throughout the process to ensure you understand your rights and full implications of the decisions you make. We can ensure that the agreement covers all the aspects that you need to include to make this a legally binding agreement.
Mediation provides a private, non-pressured environment and confidential space. It enables you to discuss your concerns whether financial or relating to your children and work through them to find the best solution for you both and your family. Mediation also offers flexible timescales that suit you both and a more cost-effective way of resolving issues following your separation.
If an agreement cannot be reached then an application can be made to the court. The court process will provide a set timetable that parties will need to follow which will involve attending court. Negotiations will always continue throughout the court process. If the parties fail to reach a resolution then the court will provide direction and guidance and ultimately, the judge will make a decision.
Arbitration is an alternative to the court process when dealing with financial issues with your solicitor. Arbitration is useful when you and your partner cannot reach an agreement and are looking to obtain a binding decision. You can set your own timescale, arranging hearings for times and dates that suit you both, and knowing that there will be no unnecessary delays or adjournments.
