When the marriage breaks down irretrievably - Divorce or Legal Separation where appropriate. Parental Responsibility, as a father - if you are not married to the mother of your child you may not have parental rights, duties and responsibilities to your child. Specific Issues, such as schooling and disagreements as to which country a child may live.
We have therefore attempted to make the process as straightforward and "painless" as possible. Upon receipt of the completed Will Questionnaire we will then either contact you with a view to making an appointment with our William Morgan, so as to take your further instructions, or alternatively supply you with a draft Will for you to consider.
It is the duty of the Executor, appointed within the Will, to obtain the Grant of Probate and distribute the deceased's assets in accordance with the terms of the Will. Where someone dies leaving a Will and also sizeable assets (eg: a house or liquid assets in a bank account in excess of 15,000) then before these assets can be sold or released to the beneficiaries under the Will a document called the Grant of Probate must be obtained.
This is a document whereby a person (the donor) appoints another individual or individuals (the Attorney) to act on their behalf in relation to their property and affairs. In other words it is a formal process by which one person can empower another to deal with their financial affairs - such as writing cheques on behalf of the donor even selling the donor's house if the document allows.
