The following notes may be of help to anyone who is Bankrupt or contemplating Bankruptcy in understanding some of the implications of insolvency. When you are made Bankrupt it is as a result of either a Bankruptcy Order issued by the Court (on a creditor's petition) or by the Adjudicator (on a debtor's application).
The following notes may be of help to anyone who is in financial difficulty or who is Bankrupt to understand some of the implications of insolvency. An Individual Voluntary Arrangement (IVA) is in many cases preferable to Bankruptcy as it is beneficial both to creditors because of the lower costs, and to a debtor because it avoids the permanent black mark of Bankruptcy.
Previously they had not been, due to a mistake in the drafting of the legislation, but this has now been corrected. There will be no need for any Court hearing but the application will need to be made through an approved intermediary, such as a Citizens Advice Bureau. The cost of applying for a DRO is 90.
A Debt Management Plan (DMP) is simply an informal arrangement for someone who cannot afford to pay all the instalments on their debts in full. Usually it will be done through an independent third party such as a Citizens Advice Bureau or possibly a commercial provider. A summary of your household income and outgoings will be prepared and sent to each creditor together with a breakdown of all the debts.
