Bankruptcy is a way of distributing a person's assets among his creditors. The term of bankruptcy was formally 3 years, however the Enterprise Act 2002 reduced this period to automatic discharge after 12 months. At the Official Receiver's discretion, this period can be shortened to as little as 6 months, if the bankrupt is co-operative.
An administration is an application to the court to put an Insolvency Practitioner (IP) in place to administer the affairs of a company, normally for a relatively short period of time up to a maximum of 12 months, although this period can be extend by application to the court by the administrator. Achieving a better result for the company's creditors as a whole than would be likely if the company were wound up.
