PAYE for Nannies Ltd is a small family company, based in Norfolk, which has been providing specialist payroll services for over fourteen years to over five thousand clients. Although we primarily run payrolls for nannies, we handle a great many payrolls for other domestic employers including larger household staffs and a significant number of small businesses.
When you take on a domestic employee, you become an employer and have to calculate tax and National Insurance for your employee, with all the legal and financial responsibilities that entails. Whilst not particularly difficult, these are time-consuming and bureaucratic, and unless you are familiar with the details of PAYE, offer many opportunities to make mistakes.
Sadly, we see many contracts which have been put together by nanny employers either by downloading and amending an example contract found on the internet or by filling in the blanks in a template contract supplied by a nanny agency.
We would caution prospective employers that probably 90% of such contracts do not conform to current employment law and in many cases will result in the employer not only losing any case taken to an employment tribunal but having any award against them increased by up to 25% as a penalty for not conforming to current legislation.This must be provided to them on or before their first day of employment.

The legislation brought in a few years ago in respect of Workplace Pensions has so far only affected large employers. However, it now applies to even the smallest employers who may only have a single employee. All employers, including employers of nannies, are affected by this.
The requirements are quite complex and rather bureaucratic and, in keeping with recent trends, failure or lateness in complying with the requirements will mean that the employer may incur substantial penalties which will be levied by the Pensions Regulator.
